Series: Leipziger Beiträge zur Orientforschung

The series Leipziger Beiträge zur Orientforschung is devoted to topics and problems of the Islamic world, past and present. It covers a range of disciplines, regions and methods, from legal, historical, religious, cultural, linguistic, political, social and economic questions to comparative area studies. The series includes the conference volumes published in cooperation with the Gesellschaft für Arabisches und Islamisches Recht e.V. The individual publications aim to foster intercultural understanding, to point to new research approaches and to present the results of academic research.

This volume, published by the Gesellschaft für Arabisches und Islamisches Recht (GAIR), grew out of the Society’s annual conference held in October 2016 at the Max Planck Institute for Foreign and International Criminal Law in Freiburg. The papers are now published together with two further contributions on related topics. The articles focus on Islamic criminal law in Iran and Pakistan, particularly religious offences (blasphemy and the defamation of persons or objects regarded as sacred) and sexual offences (adultery, homosexuality and rape). They are complemented by studies on the purposes of punishment in Shiʿi criminal law, on the interpretation of the sharia by the ‘Islamic State’ (IS) and on the Iranian Bar Association.

The volume contains the papers given at the annual conference of the Gesellschaft für Arabisches und Islamisches Recht (GAIR) at the University of Göttingen in October 2015. The theme of the conference was ‘Genderforschung und Genderfragen im islamischen Recht’ [Gender Studies and Gender Issues in Islamic Law]. The papers are complemented by two further specialist contributions on related topics. On the one hand, the authors examine the role and significance of gender studies in law. On the other, they use empirical examples to define and discuss the position of the sexes in German law and in Islamic law, both in Germany and in the Muslim world. The book is available from bookshops or can be ordered directly from the publisher via this link.

The tenth volume of the series ‘Beiträge zum Islamischen Recht’ is dedicated to Professor Dr. Hilmar Krüger, who initiated and inspired the founding of the Gesellschaft für Arabisches und Islamisches Recht. It contains articles based on papers given at the Society’s annual conference in Leipzig on 17 and 18 October 2014. On the one hand, it addresses the role of Islamic law in the legal orders of the modern Arab world. On the other, the authors examine specific legal conditions, for instance in Egypt and the Arab Gulf states. The volume is addressed both to lawyers who deal with the Arab world in practice or in theory and to scholars of Oriental and Islamic studies interested in legal developments and possible legal perspectives in the Arab countries. It also discusses questions of legal relations between Arab countries and Europe.

The book contains the contributions to the 2010 annual conference of the Gesellschaft für Arabisches und Islamisches Recht. Held in cooperation with the Centre for Area Studies of Leipzig University, the conference was devoted to the general theme of ‘legal transfer’. Within this theme, speakers and participants focused primarily on the transfer of state law and of other legal norms, particularly Islamic ones. They also discussed the transfer of law resulting from the movement of judges, lawyers and other legal actors from one jurisdiction to another. The geographical reference point was first of all the Arab world itself, but legal transfer into and out of this world was also discussed. Overall, the conference observed the emergence of new legal spaces as a result of legal transfer. The role of the state is often limited to the practical enforcement of law.

Published by the Gesellschaft für Arabisches und Islamisches Recht e.V., this volume comprises contributions presented at the Society’s 2006 conference in Cologne. The first thematic focus is private international law, with particular reference to the Arab world. It examines problems of German ordre public in relation to Islamic inheritance law and specific legal questions in Lebanon and the United Arab Emirates. The second focus is the reform of civil, commercial and family law in the United Arab Emirates. In addition to theoretical discussions, the volume addresses practical questions of commercial law relating to the United Arab Emirates. Comparative legal analysis serves as an important method for describing changes, problems and obstacles.

Published by the Gesellschaft für Arabisches und Islamisches Recht this volume deals in its first section with problems of public and private law relating to Islamic law in Germany. These questions are relevant because of the growing presence of Muslims outside the ‘traditional’ Islamic regions. The second section addresses intellectual property law in the Arab countries, showing that Egyptian law plays an outstanding role in this field as well. The contributions in the third section are aimed particularly at readers who, in addition to theoretical knowledge, are interested in practical advice for their work or studies.

Islamic law, the sharīʿa, decisively shapes the legal orders of North Africa and the Middle East. The contributions to this volume, most of them presented at the 1999 annual conference of the Gesellschaft für Arabisches und Islamisches Recht e.V. and dedicated to its first chair, Professor Dr. Ernst Klingmüller, deal with theoretical and practical problems in the application of Islamic legal norms. Besides questions of civil and commercial law, they focus above all on family law, the law of parent and child, and inheritance law in the region. The contributions underline the flexibility and capacity for development of Islamic law.
